III  Establishment of Quorum, Agenda Review-agreed

IV  Public Comment

1. Reg Welk, resident of Pembrook St., Park Hill

discusses issue of excessive speeding on Winsor Blvd and area in front of Shamel Park to the Highway. Would like to see deer crossing or other slow speed sign in the area.  Recent injury and death to small fawn being hit by speeding car was witnessed by residents of the area.  Speed indicator trailer set up by County has not helped to a noticeable extent. Has written letters to all appropriate county agencies and reads another letter he wrote last year  re. this issue.

2. Juay Olson- lives on Main Street near Venus Arms Apartments-Also concerned about speeders in her area.  Has painted the curb red to discourage parkers from parking to the right of the driveway, which blocks ability of apartment dwellers to exit the parking area in a safe mode. The county has told her it will fine her for each day that the curb remains painted. She has come to ask the Council for help with this issue. Most of the residents have almost been hit by cars speeding by.

3. S.Cole-reiterates need for signage in area around Shamel Park

Questions Erwin O., who lives on Lodge Hill, where deer signs are located.

County offers to install speed trailers once again.

Supervisor Bruce Gibson offers solution of perhaps reducing speed limits on certain streets in Cambria.

Traffic committee will also work on solving problem.

4. G. Robinette, council member, and Park Hill resident is encouraged by comments heard tonight re. safety of deer and solutions offered.

Tom Gray-curve in front of Shamel Park is dangerous.  Inadequate signage.

V Council Members’ Comments-include G. Robinette, above

1. Ralph Covell-has Ranch at end of Bridge Street, over 1000 acres.  A fire in this area could potentially burn down the whole town. Needs to have a 100 foot firebreak along Bridge Street in the near future so special grant is able to pay for all of it.  The grant will expire soon and the town will have to pay for it sometime in the future. Speaks of the  possible devastation to owners of  destroyed homes .  Has worked for 12 years with County and Nature Conservancy.  Has hired a pine tree expert to work on Covell Ranch fire management.

Members of Greenspace Board of Directors ( Valerie Bentz, Rick Hawley, and others ) have expressed opposition to the way in which the trees will be removed, the spreading of native and non-native seeds among the forest, the displacement of animals, etc.

Now the Coastal Commission also wants to be included in the decision to create/not create a firebreak.

Attended County Meeting with members of Greenspace present.  County had legal counsel present. County says permits are needed to clear land for fire protection.

Project need to be completed by May 2011 for available funds to be used.

 Project needs to go forward.

County:  if a Coastal Permit is needed to build a firebreak, no firebreak will ever be built.

Greenspace is against the firebreak project.  Covell Family has nothing to gain by this project.  Suggests that all concerned Cambrians contact the Supervisor, the county personnel, fire officials and others to voice their concern.

Opposition defies common sense.

2. E. Ohannesian-questions County re. speed survey on Winsor Blvd.  Cty will try to investigate solutions.

3. Bob McLaughlin-recent accident on Highway One.  Would like to work on a no passing zone between Cayucos and Hearst Castle…topic of discussion for next traffic committee meeting on the first Monday of November at Rabobank at 6:30 PM.

VI  Consent Agenda

Approval of Minutes of Sept. 21, 2011 and Treasurer’s Report: current balance of $1,050.40

VII  Public Agency Reports

1. District 2 Supervisor Bruce Gibson

Santa Rosa Creek Road project almost finished.

CCSD-thanks for trail connector.

Also, excess speed a problem in all communities.

K. Tanner-potholes on Green Street between Ardath and London.

 IX  OLD BUSINESS

1. Election By-Laws Revision Report

A.Rice-absent.

2. Energy-wise Proposals by council members

Mary Giacoletti- I urge the NCAC, as I urged the Planning Commission, to require the inclusion of soot/black carbon as a  significant local greenhouse gas in the EnergyWise Plan, and adopt strategies to mitigate.  Since there is no referenced title or number, this suggestion applies to the document as a whole.  Joyce Renshaw-reads letter from a senior citizen in San Simeon re. wood smoke (soot) in the air, specifically Cavalier Inn and Restaurant.  Burning does well into the night.  Damaging to health and welfare of senior citizens.  Mrs. Anderson from San Simeon.

Motion made to accept Mary Giacoletti’s statement explained above.

Vote Taken:  5-in favor(Chair votes in favor)

4 – against

1 abstention

Motion passes.

Debby Mix- 1. Building Energy Scores:  The county wants to audit all residential and commercial properties built before 2000 for an energy audit then require that the sellers of such properties meet the new requirements before selling.  This will make it impossible for many sellers to sell their property.  Depending on the retrofits, this will place an onerous burden on the sellers.  This has the potential to stop many property sales in this county adding to the already difficult market.  Reference Chaptre 5, page 11. (also retrofit on Water???)

Motion made to have the County reject the above proposal.  Vote:  8 in favor( of rejecting the County’s proposal) , 1 against.  Motion passes.

2. Renewable Energy Proposal:  Add another oversight body to increase local control over programs so that up to 50% of electricity is from renewable sources.  It is my understanding that at this time we don’t have the technology to meet this goal.  They want to protect areas that contain renewable energy resources such as wind, solar, geothermal and hydroelectric.  This might amount to seizing private property for renewable installation.  Chapter 5, page 20.

Motion to have the County reject the Proposal.  Vote: 7-in favor, 2 against. Motion passes.

3. Expand retrofit upon sale for water use device.  Chapter 5, page 53.  Again applying an onerous burden on the seller.

Discussion:  Gibson: benign proposal. Only involves toilet, sink faucets and showers.

Motion made to approve above proposal.  Vote: 8-in favor, 1 against.  Motion passes

4. Amending land use ordinances for small scale renewable overlays.  There are no defined areas for any of this.

Discussion: includes Windmills, solar panels, etc.

Motion made to approve above proposal.  Vote:  9-in favor.  Motion passes

 5. Opportunities for terrestrial and aquatic sequestration including but not limited to open lands.  Chapter 5, page 69.

Discussion: carbon dioxide isolation instead of greenhouse gas.

Motion to ignore: (?) Vote: 8-in favor.   Motion passes

Thank you to Debby Mix for her work.

Erwin Ohannesian:  erosion on Santa Rosa Creek Road caused by creek.

 The Beautification of Cambria

The following article was written by Consuelo Macedo and appeared in The Cambrian.

Literally “taking the bull by the horns”, resident rancher/historian and President of El Pinal Parlor #163 of Native Daughters of the Golden West, Dawn Dunlap has initiated a concerted effort to clean up and beautify all of Cambria. “There used to be a separation of the original historic Cambria, Cambria Pines by the Sea in “west village”, and Moonstone Beach properties. Now we have all grown together and should be identified as a single Cambria, with a vested interest in showing pride in our community!”

Dunlap broached the topic at the last NCAC meeting Sept.21, where she addressed the need to move forward with the “Community Pride in Cambria” project, and later conferred with Jerry Gruber, manager of the CCSD. The Cambria Historical Society has agreed to partner, with a view to celebrating Cambria’s 150th anniversary of recognition by the federal government with the establishment of the post office on Oct.2, 1867 at the corner of Main and Bridge Streets.

Since the Scarecrow and Harvest Festival is this week-end the logical place to start was at the corner Center and Bridge Street near the current post office, working toward the museum, as well as up Bridge Street and in front of the businesses on Main Street. The CCSD has already power washed the stone trash containers and done some street sweeping, and will address maintenance of the pocket park which replace their previous office site.

On Monday, Oct.3rd , Dunlap, Joyce Renshaw, Linda Finley, Jean Chinnici, Denise Schaupp, Marj Sewell and Consuelo Macedo, ranging in age for 60-80, enlisted Bridget Smith, 39, and two young men in their 20’s to assist them in weeding, raking, pruning and sweeping for the initial two hours on concerted effort to beautify the area. They hope to inspire businesses to join organizations also who have had or will have clean up projects, such as the Historical Society, Rotary Club of Cambria, Cambria 4-H, the Village Pharmacy mural, Blair and Shana McCormick’s ongoing maintenance of Main Street roadside planters, and the Cambria Club’s grooming of the center street medians.

The Native Daughters of the Golden West, established on Sept. 25, 1886 in Jackson, California, recently celebrated their 125th anniversary. Call Dawn Dunlap at 927-1074 for information about membership and Community Pride in Cambria.

Noted by Erwin that ATT denied  request to make improvements to the front of their building on Bridge Street in front of Post Office, i.e. useless driveways which inhibit parking.  Erwin states that no citizen will be issued a traffic citation for parking in front of the “useless driveways.”

X  NEW BUSINESS

III  Public Comment Period

1. Robert Davis from SLO Bike Club re. annual event on Sept. 24th, beginning at 7 am.

reads from letter attached:

San Luis Obispo Bicycle Club will host its 40th annual Lighthouse Bike Ride for Charities on September 24th, 2011.  We expect about 1,200 bicycle riders on the route starting at 7:00 a.m.  We tell all the riders that we require them to ride safely, to observe traffic laws, to share the road with cars, and to respect local residents.

The week before, on the 17th, we’ll have a smaller event, over the same route, with about a hundred club members to pre-ride the course.

The route is mostly on Highway 1 between Cuesta College and Piedras Blancas.  About half the riders will go up Old Creek Road and then west on Highway 46 back to Highway 1.

The others will go through Cayucos and ride on Highway 1 to Cambria.  We will have a refreshment stop at the Hamlet and another at Cappuccino Cove.  We will serve lunch at Shamel Park.  The Bike Coalition will set up racks at Shamel Park for people to park their bikes off the road. The course will open at 7:00 a.m. and close at 5:00 p.m.We have contracted with CHP to pay for three units to patrol the route. The Lighthouse bike ride for charities is one of the bike club’s two annual fund raising events.  Our purpose is to raise money to fund local high school and college scholarships and to support local charities.   This year we are donating more than $55,000 from our events to San Luis Obispo county schools and charities.  That includes donations this year to Piedras Blancas Light Station Association and to the Gene Cerise Memorial Bike Ride to raise money to support Cambria Teen Center. We also support CCCMB so that they can build and maintain trails in MBSP and MdO. We try to work with local communities to make the ride safe for everyone and to minimize the impact of the event. We ask that you help us by passing the word to your neighbors about the ride.  Anyone can contact the club for more information by calling 543-5973.

The Cambria Lodge Hill Restoration Program

Program History:

Planning started in 1984-85

Cambria/Lodge Hill Restoration Program-July 1985

Adoption of TDC Ordinance in the County’s North Coast Area Plan and Local Coastal Plan

Coastal Conservancy loan of $272,500 in 1986

Land Conservancy of SLO County starts buying lots and selling TDCs.

1999-2003-Discussions with CCSD about transfer of ownership

2003-First transfer of 88 parcels comprised of 200= legal lots completed with retained conservation easement. Agreement to provide $3000. / per year in maintenance costs to CCSD

2008-Additional Coastal Conservancy loan of $200,000-to purchase Madonna lots in Fern Canyon.

By the Numbers:

number of tax parcels acquired, 143(including doubles and triples)

number of legal lots acquired=446

total value of the program=$817,936.06

Cash currently on hand= $70,305.55

Number of TECs on hand-128,774

Number of TDCs sold-92,379

Cost of a TDC= $15.

One TDC=One Square Foot of Gross Structural Area

Into the Future:

Proposed transfer of 55 parcels to Cambria CSD

Conservation easement monitoring

Ongoing stewardship and enhancement activities i.e. trails, invasive species management

Continued lot acquisition for conservation purposes

Opportunities through Cambria CCSD ownership for additional public benefits such as trail linkages, pocket preserves and community gardens where appropriate

Consider sources of revenue for ongoing maintenance needs throughout Cambria.

Now, however, maintenance costs much higher than $3000.=-weed abatement costs and also more lots to maintain.

Also, trees falling on lot, and dangerous trees leaning toward neighbors’ homes.

Lodge Hill TDC Program

Is this program still beneficial for Cambria’s needs?  The program works because of its small scale. Market based approach to solving a land use issue.

John Lamb-could you raise the cost of TDC to cover maintenance? yes.

at some point, the Land Conservancy will stop buying lots.

Total-25 acres.

The easement is in perpetuity.  What does the easement allow? Trails, benches, community meeting area, perhaps a community garden

And disallow? building structures, tree removal.

goal-protect open space and Monterey Pine forest

Discussion/Questions

Buildout  Reduction Plan-a few of the 55 parcels are considered buildable.

CCSD Director-committee being formed to consider issue of lot buyouts  in the future. Gerry will return once committee is formed.

Land Use/Project Review Report

1) DRC2010-00084 WAGNER – Minor Use Permit for the addition of a 294 sf media room and 380 sf one-car garage, using TDCs, to an existing SFR.

Location:  210 Orlando Drive, Cambria; APN 023-014-027

Link to application file: http://www.slocounty.ca.gov/Assets/PL/referrals/coastal/DRC2010-00084_WAGNER.pdf

SUMMARY: This project would expand an existing 2,205 sf residence to 2,499 sf, with a GSA of 3,319 sf., on a 6538 sf corner lot at Orlando Drive and Sherwood Drive in Marine Terrace.  A single-car garage would be built adjacent to the existing two-car garage. Over the existing garage, the second-floor living area would be extended with a new media room, opening to a new 196 sf non-permeable deck. The new deck would replace a non-permeable deck of 229 sf. The proposed GSA will require 312 sf of TDCs, less than the maximum of 400 sf for a lot of this size.

The proposed addition is designed to match the style of the existing residence, makes suitable use of a recently merged single lot and has no negative impact on the surrounding streetscape or neighboring properties.

LAND USE COMMITTEE RECOMMENDATION: Approve

Motion to approve: Motion passes unanimously.

2) DRC2011-00001 BROCKWAY – Minor Use Permit for an addition to an existing residence, plus new garage and shop building.

Location: 2110 Trenton Ave., Cambria; APN 023-401-026

Link to application file: http://www.slocounty.ca.gov/Assets/PL/referrals/coastal/DRC2011-00001_BROCKWAY.pdf

SUMMARY: This MUP applies to proposed additions at 2110 Trenton, including a garage, storage shed, greenhouse, library, office and other rooms totaling 2,015 sf of added living area. Total living area would be 3,023 sf, with GSA of 4,175 sf and a footprint of 2,257 sf.  Area of site disturbance would total 4,600 sf. All these areas are within allowances for a lot of this size – 10,778 sf. The proposed additions would be an enhancement to the property, with no negative visual impact on surrounding properties or streetscape.  The applicant’s site plan identifies four Monterey pine trees, said to be “all diseased and leaning” that would be removed. If any of these trees are found, on further inspection, to be healthy and not a threat to buildings, they should be replaced by a 4-to-1 ratio elsewhere on the property.

The Committee recommends approval of this MUP, on condition that the lot be cleared of any storage facilities or other equipment not needed for this project or the ongoing renovation of the existing home (i.e., window replacement and kitchen remodel).

LAND USE COMMITTEE RECOMMENDATION: Approve, with condition noted above.

Discussion: shipping containers on property.

A. Rice: concerns about property, in area of town she represents.  there is a drainage issue at the site.  Also thinks the proposed house addition is too large.

S. Castaneda-year round creek runs through the property.

On permit, it says there is no drainage problem/

visual impact-20 feet from street.

J. Butler- if council approves a project with conditions, most of the time, the conditions are ignored.

Project not approved.

Motion to send letter with concerns of storage containers on property, poor drainage, and  negative visual impact.

Motion passes unanimously.

3) DRC2011-00002 HUNTER – Minor Use Permit for an addition to an existing SFR, including a new bedroom, bathroom, upper deck and addition to lower deck.

Location: 512 Darby Lane, Cambria; APN 022-083-003

Link to application file: http://www.slocounty.ca.gov/Assets/PL/referrals/coastal/DRC2011-00002_HUNTER.pdf

SUMMARY: The proposed project would add 498 sf of living area to an existing 1,490 sf home, plus an added 45 sf of permeable deck and 190 sf of new non-permeable deck. The GSA would increase from 1,952 sf to 2,450 sf. The new living area would be added primarily by extending the second floor roof and adding a floor across what is now an open area over the living room. The new non-permeable deck would be off the new second-floor living room and bedroom, replacing the current roof.  The footprint would be little changed, increasing to 1,538 sf from 1,452 sf.

This project is mainly an internal expansion, without major changes in footprint or profile of the existing home. It would be an enhancement to the property and have no negative impact on surrounding views, privacy or streetscape.

LAND USE COMMITTEE RECOMMENDATION: Approve

Discussion: no concerns.

Motion to approve-motion passes unanimously.

Permit to extend a walkway 109 feet.

Location: Along Moonstone Beach Drive and Windsor Blvd.; APN 022-061-011

Link to application file: http://www.slocounty.ca.gov/Assets/PL/referrals/coastal/DRC2011-00005_CAMBRIA_CSD.pdf

SUMMARY: This CCSD project would close a short but significant gap in the Coastal Trail at the corner of Moonstone Beach Drive and Windsor Blvd. The current walkway is dangerously narrow at this point, where traffic from Moonstone Beach approaches Windsor for right turns to Shamel Park and Park Hill, or left turns to Highway One and the West Village.

The walkway plan includes a wood retaining wall to allow widening of the pedestrian zone to 8 feet, as well as a guardrail on the downslope side facing Santa Rosa Creek.  This project has been thoroughly studied as to environmental impacts and other factors, and the Committee strongly recommends that construction begin as soon as feasible.

LAND USE COMMITTEE RECOMMENDATION: Approve

Discussion: Gail Robinette: has been involved in project for several years. Interesting project because it is a trail and governmental agencies involved. Is dangerous because of foliage and traffic.

Project is a County right-of-way.  Is part of California Coastal Trail.  Hopes to have this project completed by Christmas.

Motion to approve:

Motion passes unanimously.
